Proposals for settlement
Proposals for settlement, served inside the window.
Every proposal, ours and theirs, with its window, acceptance deadline and status, drafted for § 768.79 and Rule 1.442.
Makes money: Fee-shifting leverage, with no proposal-for-settlement window missed.
The problem
Why it's hard today
A proposal for settlement is one of the few tools that can shift attorney's fees, and it is unforgiving. Served too early, or made jointly without apportionment, it can fail when the fee motion is heard.
The windows run per defendant from service of process, and the other side's proposals carry their own acceptance clock.
How it works
4 steps, start to finish
- 1
Track ours and theirs
Offeror, offeree, amount, apportionment, served date, acceptance deadline and status for every proposal on the case.
- 2
Window alerts
The earliest and latest service dates are counted per defendant from the rules, and a proposal is served only inside its window.
- 3
Draft and check
The proposal is drafted from a strict template with the certificate of service inside the document. A joint proposal without apportionment is blocked.
- 4
Serve by email, never file
The Rule 2.516 service email is drafted for approval; proposals are not filed with the court. After judgment, the 25% comparison shows whether a fee claim may be worth pursuing.
Approval: The service email waits in the approval queue and is sent exactly as approved. Window dates are shown for an attorney to verify.
Questions
Proposals for settlement: FAQ
Does it decide whether we are entitled to fees?
No. The calculator compares the judgment figure your attorney enters with the proposal. Entitlement is the attorney's call.
Does it draft notices of acceptance?
Not yet. It tracks the acceptance deadline; responding stays with the attorney.
Does it track the defense's proposals too?
Yes. Proposals served on your client are logged with their acceptance deadline, so the clock is visible to everyone on the case.
